I understood that the N.Switch hack is hardware based. So will i be banned if i would boot the switch without the microSD with the CFW content, and play an original game online?

no, taking your sd card out will not protect you from being banned.
not even resetting your console to default will protect you
in this scenario the only way is to restore you NAND back up.

You will be safe when you know what you are doing. Use emuNAND, different sd cards and dont put any illegal crap or home-brew in your sysNAND and you will be fine. Have been using this method for almost a year now.
