Bioshock wont start after online ban check

So I haven't been in the scene for several months. Scrolling through Twitter I noticed Bioshock was coming out, so I dusted off my switch in preparation. When it appeared on here I realised it needed FW 9.1 (I was still on 9.0), so I upgraded etc, but when trying to start the game it does an online check, then reminds me that my console is banned and wont start. If I try on Flightmode, it just tells me to turn flight mode off.

Has anyone else encountered this?

A way around it?

since you upgraded firmware did you also updated sigpatches ?
 
I did, using sigpatch updater 0.1.2 that I had on there from before the update
 
dont use sigpatch updater. it broke on 10.x.x. go do it manually

i am a fan of sigptch updater. the problem is that you need to update "IT" first in your sd card if you want it to work
